109 'LVDELOLW\ EHQHILWV The Disability benefits are governed by (PSOR\HHV 6RFLDO 6HFXULW\ $FW which provide social security for matters related to employee injuries.The disability benefits are managed by the Social Security Organization (SOCSO). SOCSO is mandated to administer and enforce the Employee Social Security Act 1969 and Employee Social Security General Rules 1971. SOCSO only covers Malaysian workers and permanent residents. As a result, foreign workers are protected under the Workmen's Compensation Act 1952. Apart from foreign workers, SOCSO also does not cover a person whose wages exceeds RM4,000 a month, government employees, domestic servants employed to work in a private dwelling house which includes a cook, gardeners, house servants, watchman, washer woman and driver. A person that „ takes employment under an employer under the contract of a service or apprenticeship contract ” is defined as „employee”. All employees are eligible to register regardless of employment status either temporary, part-time or in probation. The disability benefits offered by SOCSO are comprehensive. It covers medical treatment, facility for physical or vocational rehabilitation, and financial assistance to employees if they lost their abilities due to accidents or diseases that have reduced their abilities to work or rendered them incapacitated. In addition, the death benefit is provided to their dependants through a pension. The benefits offered by SOCSO are funded under two schemes which are the Employment injury schemeand the Invalidity scheme benefits (SOCSO, 2017). The benefits provided by both schemes are listed in Table 1. An „employment injury” is defined as a personal injury to an employee caused by accident or an occupational disease arising out of andin the course of his employment in an industry. On the other hand, invalidity is defined as a permanent morbid condition that are unlikely to be cured that result in an employee losing at least 1/3 of his or her capability compared to a normal individual, which ultimately causes a loss of income for the employee. The protection under the employment injury schemes covers the following: (I) Industrial accidents while carrying out duties; (II) Accidents while travelling to work; (III) Accident during emergency. Example: fire disaster at employer's premise; (IV) Occupational Disease. Diseases resulted from his occupation as described in the Fifth Schedule of Employees’ Social Security Act 1969.
